These Terms of Service ("TOS") govern your purchase, download, and use of the 3D character model ("Model") provided by MonsterBox Entertainment LLC ("We," "Us," or "Our"). By downloading or using the Model, you ("You" or "User") agree to be bound by these terms. If you do not agree, do not download or use the Model.
1. License Grant
Subject to your compliance with these TOS, We grant you a limited, non-exclusive, non-transferable, revocable license to download, access, and use the Model solely for personal, non-commercial purposes, including animation work. This license allows you to create animations, renders, or derivative artworks featuring the Model, provided that all intellectual property rights in the character remain exclusively with MonsterBox Entertainment LLC. You may not sublicense, sell, rent, lease, or otherwise distribute the Model or any derivatives thereof without Our prior written consent.
2. Permitted Uses
Animation Work: You may use the Model in personal animation projects, such as short films, videos, or artistic expressions Attribution Requirement: For any new renders, animations, artworks, or other creations derived from the Model that you share publicly (e.g., on social media, websites, or portfolios), you must prominently tag @MonsterBoxENT on Twitter (or its successor platform) and include a credit line stating: "Character Model by @shywearsfangs." Failure to do so may result in revocation of your license.
3. Prohibited Uses
You are strictly prohibited from using the Model in any manner that:
Involves VTubing (virtual YouTubing or similar live-streaming avatars).
Supports game development for profit, including but not limited to creating, modifying, or integrating the Model into video games, apps, or interactive media intended for sale, in-app purchases, or any revenue-generating activities.
Relates to subscription services, such as Patreon, OnlyFans, or any platform where access to content featuring the Model is gated behind payments or subscriptions.
Infringes on Our intellectual property, including reverse engineering, decompiling, or extracting elements of the Model for unauthorized purposes.
Involves commercial exploitation, such as merchandising, advertising, NFTs, or any for-profit endeavors without Our explicit permission.
Distributes, shares, or uploads the Model to third-party sites, file-sharing services, or repositories.
Uses the Model in any illegal, harmful, or offensive context, including but not limited to hate speech, discrimination, or violation of applicable laws.
4. Ownership and Intellectual Property
All rights, title, and interest in the Model, including copyrights, trademarks, and any derivative works, remain solely with MonsterBox Entertainment LLC. You do not acquire any ownership rights through this license. Any modifications or derivatives you create must not claim ownership over the underlying character, and We reserve the right to use, modify, or license the Model independently.
5. Termination
This license terminates automatically if you breach any provision of these TOS. Upon termination, you must immediately cease all use of the Model and destroy all copies in your possession. We may also terminate this license at any time without notice for any reason.
6. Disclaimer of Warranties
The Model is provided "AS IS" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Model will be error-free, secure, or compatible with your hardware/software.
7. Limitation of Liability
In no event shall MonsterBox Entertainment LLC be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Model, even if advised of the possibility of such damages. Our total liability shall not exceed the amount you paid for the Model.
8. Indemnification
You agree to indemnify and hold harmless MonsterBox Entertainment LLC, its affiliates, officers, and employees from any claims, damages, losses, or expenses arising from your misuse of the Model or violation of these TOS.
9. Governing Law
These TOS shall be governed by the laws of the State of Colorado, United States, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the courts located in Boulder County, Colorado.
10. Changes to TOS
We reserve the right to modify these TOS at any time. Continued use of the Model after changes constitutes your acceptance of the updated terms.
